U.S. Sues American Co. For Requiring Workers to Speak English

The United States government is actually suing a private American business for discriminating against Hispanic and Asian employees because they don’t speak English on the job.

It involves a Green Bay Wisconsin metal and plastic manufacturer that fired a group of Hmong and Hispanic workers over their English skills, “even though those skills were not needed to perform their jobs,” according to the feds. More importantly, forcing employees to speak English in the U.S. violates Title VII of the Civil Rights Act of 1964, says the Obama administration.

Here’s the twisted explanation from the Equal Employment Opportunity Commission (EEOC), the federal agency that enforces the nation’s workplace discrimination laws; the Civil Rights Act protects employees from discrimination based on national origin, which includes the linguistic characteristics of a national origin group. Therefore, according to this reasoning, foreigners have the right to speak their native language even during work hours at an American company that requires English.

Requirements of English fluency and so-called English only rules are often implemented to make what is really discrimination appear acceptable, says the government attorney handling this case. “But superficial appearances are not fooling anyone,” he assures. “When speaking English fluently is not, in fact, required for the safe and effective performance of a job, nor for the successful operation of the employer’s business, requiring employees to be fluent in English usually constitutes employment discrimination on the basis of national origin — and thus violates federal law.”

During a speech at a fundraiser for congressional Democrats in La Jolla, California yesterday, President Barack Obama urged “wrongheaded” Americans to place more trust in the government.

Obama stated that a perception on behalf of middle class families that people in Washington did not care about them has reinforced “apathy or a lack of confidence in our government,” before he went on to blame Republicans for making Americans think, “they’re on their own and government doesn’t have an appropriate role to play.”

Obama said the Democrats’ goal in the midterms was to “break that grip” and reverse the “wrongheaded vision” that big government is not the answer.

And just this week, Senator Marco Rubio and Congressman Paul Ryan – both potential White House hopefuls – have made the issue their own, with Rubio proposing his own changes to anti-poverty programs and Ryan discussing it with NBC’s Brian Williams.

To be sure, this has traditionally been a Democrat issue and we have recently seen the Democrats push to increase the federal minimum wage and extend unemployment benefits.

President Obama’s Top 10 Constitutional Violations Of 2013

One of Barack Obama’s chief accomplishments has been to return the Constitution to a central place in our public discourse.

Unfortunately, the president fomented this upswing in civic interest not by talking up the constitutional aspects of his policy agenda, but by blatantly violating the strictures of our founding document. And he’s been most frustrated with the separation of powers, which doesn’t allow him to “fundamentally transform” the country without congressional acquiescence.

But that hasn’t stopped him. In its first term, the Administration launched a “We Can’t Wait” initiative, with senior aide Dan Pfeiffer explaining that “when Congress won’t act, this president will.” And earlier this year, President Obama said in announcing his new economic plans that “I will not allow gridlock, or inaction, or willful indifference to get in our way.”

And so, as we reach the end of another year of political strife that’s fundamentally based on clashing views on the role of government in society, I thought I’d update a list I made two years ago and hereby present President Obama’s top 10 constitutional violations of 2013.

Lawmakers call for probe into ‘botched’ ATF sting in Milwaukee

WASHINGTON ––  Several members of Congress are calling for an investigation into an embarrassing series of blunders made by the Milwaukee arm of the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives after a newspaper reported this week that the agency conducted a months-long undercover operation that cost taxpayers thousands of dollars and netted very few results.

“I am intent on getting to the bottom of the botched ATF sting in Milwaukee,” Rep. Jim Sensenbrenner, R-Wis., told FoxNews.com Thursday night.

Sensenbrenner along with Sen. Charles Grassley, and Reps. Darrell Issa and Robert Goodlatte, have sent a letter to Acting ATF Director Todd Jones asking the agency to look into allegations reported in the Milwaukee Journal Sentinel.

The newspaper claims that the agency conducted a deeply flawed sting operation that resulted in a still-missing machine gun being taken from an agent’s car, thousands of taxpayer dollars being lost in merchandise and angry residents saying that ATF officials reintroduced crime into their neighborhood. The operation comes on the heels of the botched Operation Fast and Furious anti-gun trafficking program.

Court says Obama appointments violate constitution

WASHINGTON (AP) — President Barack Obama violated the Constitution when he bypassed the Senate last year to appoint three members of the National Labor Relations Board, a federal appeals court ruled Friday in a far-reaching decision that could severely limit a chief executive’s powers to make recess appointments.

The decision of the U.S. Court of Appeals for the D.C. Circuit marked a victory for Republicans and business groups critical of the labor board. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize.

When Obama filled the vacancies on Jan. 4, 2012, Congress was on an extended holiday break. But GOP lawmakers gaveled in for a few minutes every three days just to prevent Obama from making recess appointments. The White House argued that the pro forma sessions – some lasting less than a minute – were a sham.

NLRB board member Richard Griffin allegedly covered up embezzlement at a major labor union

nlrb-logo-300x297A recent lawsuit filed in a federal court in California alleges that National Labor Relations Board (NLRB) member Richard Griffin was complicit in a scheme to cover up embezzlement at a major labor union by terminating employees who attempted to expose the effort.

The allegations appear in a lengthy complaint filed against the International Union of Operating Engineers (IUOE). The lawsuit alleges numerous violations of the Racketeer Influenced and Corrupt Organizations (RICO) Act, and names Griffin, IUOE’s former general counsel, as a defendant.

To Sidestep Obamacare, Wendy’s Reduces Hours for Hundreds in Nebraska

Employees at various Wendy’s restaurant locations in Nebraska will work fewer hours this year, reportedly due to costs associated with Obamacare.

Under the new healthcare law, businesses with 50 or more “full-time” employees must offer health benefits to their staffers working between 32 and 38 hours. Non-managerial workers at Omaha-area Wendy’s will see their hours cut to 28 hours a week, according to local NBC affiliate WOWT.

Gary Burdette, vice president of operations for the Wendy’s franchise, acknowledged the cuts are an attempt by the franchise owner to reduce the number of full-time employees at his Wendy’s locations to avoid offering health care benefits to his staff, according to WOWT.

Wendy’s spokesman Denny Lynch stressed in a Huffington Post interview that the decision of franchise owner Scott King was his alone and not “a company decision.”

“Our franchisees are independent businesspeople, and they make the decisions regarding their restaurant teams. As small-business employers, our franchisees are facing rising food and operating costs and many new government regulations,” Lynch said.

A total of 126 documentaries were eligible for an Academy Award this year, and a selection committee recently narrowed those down to 15 hopefuls for five nominations. Dozens were snubbed, but the producers of 2016: Obama’s America say their film’s exclusion is evidence of something more sinister.

The anti-Obama film directed by Dinesh D’Souza was roundly panned by critics, though it rode word of mouth to a $33 million gross. D’Souza said the film’s success would have resulted in a nomination if it weren’t for Hollywood’s bias. “Liberal political ideology, not excellence, is the true standard of what receives awards,” he said.

Gerald Molen, a 2016 producer who won an Oscar for Schindler’s List, echoed the director’s accusation, adding: “America went to see the documentary in spite of how Hollywood feels about it.”

2016 is currently the second highest-grossing documentary in America, behind Michael Moore’s Fahrenheit 9/11, which was not eligible for an Oscar.
